תנאי שימוש

ברוכים הבאים ל-FinPlay ("האפליקציה"). השימוש באפליקציה מותנה בהסכמתך המלאה לתנאים הבאים.

1. מהות השירות והיעדר ייעוץ פיננסי

FinPlay היא פלטפורמה טכנולוגית-חינוכית ללימוד אוריינות פיננסית באמצעות משחוק (Gamification) וסימולציות. כלל התכנים, הנתונים, המדדים והסימולטורים באפליקציה נועדו למטרות תרגול והעשרה בלבד. החברה ו/או מי מטעמה אינם בעלי רישיון לפי חוק הסדרת העיסוק בייעוץ השקעות, בשיווק השקעות ובניהול תיקי השקעות, התשנ"ה-1995. שום מידע באפליקציה אינו מהווה ייעוץ פיננסי, פנסיוני, מיסויי, או המלצה לביצוע פעולה כלשהי בשוק ההון, ואינו מהווה תחליף לייעוץ מקצועי המותאם לנתוניך האישיים. כל החלטה פיננסית שתקבל/י בעולם האמיתי היא על אחריותך הבלעדית.

2. סימולטור השקעות ונתוני שוק

"ארגז החול" (הסימולטור) פועל בסביבה וירטואלית וללא סיכון כספי. נתוני השוק המוצגים בו עשויים להיות מושהים, היסטוריים או מומחשים, ואינם משקפים בהכרח נתוני זמן אמת מבורסות פעילות. הצלחה בסימולטור אינה מהווה ערובה או אינדיקציה להצלחה בהשקעות או במסחר בעולם האמיתי.

3. כלכלת משחק והיעדר אלמנט הימורים

התקדמות באפליקציה, צבירת נקודות (XP), מטבעות וירטואליים (FinCoins) ופריטים וירטואליים מבוססת אך ורק על מיומנות, ידע, למידה והתמדה (Skill-Based), ואינה כוללת יסוד של מזל או גורל. לפיכך, פעילות זו אינה מהווה "משחק אסור" או הימור כהגדרתם בחוק העונשין. למטבעות הווירטואליים אין כל ערך כספי או מסחרי מחוץ לאפליקציה, והם אינם ניתנים להמרה למזומן מול החברה. אנו שומרים את הזכות הבלעדית לשנות את "מחירי" ההטבות בחנות, להתנות או להגביל את מימושן, או לבטל את תוכנית התגמולים בכל עת, ללא הודעה מוקדמת וללא כל חובת פיצוי.

4. הגבלת גיל, כשירות משפטית ואישור הורה לרכישות של קטינים

השימוש החינוכי באפליקציה מותר מגיל 16 ומעלה. מתחת לגיל 16 — אין הרשמה. מימוש הטבות מול גופים פיננסיים חיצוניים (פתיחת חשבון בנק, מסחר, אשראי, ביטוח) מוגבל למשתמשים בני 18 ומעלה בלבד.

רכישת מנוי Pro על ידי קטין (בני 16–17) — בהתאם לחוק הכשרות המשפטית והאפוטרופסות, התשכ"ב-1962 (סעיפים 4–6), עסקה מתמשכת של קטין מחייבת אישור הורה/אפוטרופוס. לצורך כך מובנה באפליקציה תהליך אישור הורה: הקטין מזין את כתובת האימייל של ההורה, FinPlay שולחת להורה אימייל הכולל קישור אישור ייעודי, וההורה מאשר/דוחה את הרכישה ישירות מהאימייל. רכישת Pro תיפתח לקטין רק לאחר שההורה לחץ על קישור האישור. ההורה רשאי לחזור בו מהסכמתו בכל עת באמצעות קישור הביטול שנשלח באותו אימייל; ביטול הסכמה אינו מבטל אוטומטית מנוי קיים שכבר נרכש — לצורך ביטול והחזר יש לפעול ישירות מול App Store / Google Play.

5. שירותי צד שלישי ושיווק שותפים

האפליקציה מציגה קישורים, הצעות והטבות מטעם גופים פיננסיים ומסחריים. FinPlay עשויה לקבל עמלת הפניה (CPA/Affiliate) בגין פעולות שתבצע/י אצל שותפים אלו. FinPlay אינה צד להתקשרות בינך לבינם, אינה נושאת באחריות לטיב שירותיהם, וכל התקשרות מולם היא על אחריותך בלבד.

6. הגבלת אחריות ושיפוי

השירות ניתן כמות שהוא (AS IS). FinPlay, מנהליה ועובדיה לא יישאו באחריות לכל נזק, ישיר או עקיף, הפסד פיננסי, אובדן רווחים, תקלות טכניות או עוגמת נפש שייגרמו משימוש באפליקציה או מהסתמכות על תכניה. סמכות השיפוט הבלעדית תהא נתונה לבתי המשפט בתל אביב-יפו.

7. כלי בינה מלאכותית (AI) ועיבוד אוטומטי

האפליקציה כוללת מספר כלים המסתמכים על שירותי AI לעיבוד נתונים. בעת שימוש בצ'אט עם Captain Shark, בניתוח תלוש שכר, בניתוח מניות (מהיר/עמוק), בתובנות אישיות או ב-Banner Tip — התוכן שאת/ה מספק/ת מועבר באמצעות חיבור מוצפן (TLS 1.2+) לעיבוד באמצעות שירותי AI, ומתקבלת ממנו תוצאה. תוצאות AI נועדו ללמידה והעשרה בלבד, אינן מהוות ייעוץ פיננסי, פנסיוני, מיסויי או משפטי, ועלולות לכלול שגיאות, אי-דיוקים או "הזיות" (hallucinations). FinPlay אינה אחראית לתוצאות אלה ולכל הסתמכות עליהן.

8. ניתוח תלוש שכר (Payslip Analyzer)

כלי ניתוח תלוש השכר מאפשר לך להעלות תמונה או קובץ PDF של תלוש משכורת לעיבוד אוטומטי. הזרימה: • הקובץ נשלח בחיבור מוצפן (TLS 1.2+) לשרת FinPlay בלבד למשך זמן העיבוד. • מהשרת הקובץ מועבר לעיבוד באמצעות שירות AI לניתוח (פחות מ-60 שניות בממוצע). • הקובץ המקורי לא נשמר בשרת FinPlay, לא בלוגים, ולא אצל Google מעבר לזמן העיבוד. • תוצאת הניתוח המלאה נשמרת זמנית רק ב-RAM של המכשיר ונמחקת בסגירת המסך. • סטטיסטיקות מצרפיות אנונימיות (טווח שכר ברוטו בקפיצות של 1,000₪, אחוז ניכוי פנסיה מעוגל, נוכחות קרן השתלמות — בלי סכומים מדויקים, בלי שם, בלי פירוט מלא) נשמרות מקומית במכשיר ב-MMKV כדי לאפשר את פיצ'ר השיתוף עם 'הקלאן'. • ניתן למחוק את הסטטיסטיקות המקומיות בכל עת דרך הגדרות > נקה נתונים. לפני שימוש ראשון בכלי, מוצג מסך הסכמה ייעודי. המשך השימוש בכלי מהווה הסכמה מפורשת לזרימת העיבוד הזו.

9. כלים פיננסיים אינטראקטיביים

האפליקציה מציעה תשעה כלי חישוב פיננסי (מחשבון משכנתא, חישוב פנסיה, פירוק תלוש, חישוב מס הכנסה, יעדי חיסכון, ריבית דריבית, בדיקת תקציב, מחשבון חופשה, ועוד). הקלט שתספק/י לכלים אלה נשמר מקומית בלבד במכשיר (MMKV) לטובת המשך השימוש בכלי, ואינו נשלח לשרת FinPlay או לצד שלישי כלשהו. התוצאות מהוות הערכה כללית בלבד ואינן מהוות ייעוץ מס, פנסיה, השקעות או משפט. לפני קבלת החלטה פיננסית בעולם האמיתי, יש להתייעץ עם בעל מקצוע מורשה.

10. ניסויים, A/B Testing ופרסונליזציה

לטובת שיפור חוויית המשתמש, FinPlay מבצעת ניסויים אוטומטיים על וריאנטים שונים של מסכים, טקסטים והצעות (Multi-Armed Bandit). השיוך לוריאנט הוא אנונימי, אינו תלוי בזהות אישית, ונשמר ב-PostHog למטרות אנליטיקה ושיפור בלבד.

מדיניות פרטיות

FinPlay מחויבת להגנה על פרטיותך ופועלת בהתאם לחוק הגנת הפרטיות, התשמ"א-1981 ותקנותיו.

1. המידע שאנו אוספים

• פרטי חשבון ויצירת קשר: שם מלא, כתובת דוא"ל, מספר טלפון, תאריך לידה, ואווטאר. • נתוני למידה והתנהגות: התקדמות במודולים, תוצאות חידונים, בחירות ופעולות בסימולטור ההשקעות, משך שימוש, ורצפי פעילות (Streaks). • מידע טכני ודיגיטלי: סוג מכשיר, גרסת מערכת הפעלה, כתובת IP, מזהי פרסום/מכשיר ונתוני אנליטיקה. • תוכן שנשלח לעיבוד AI: שאלות שאת/ה שולח/ת לצ'אט עם Captain Shark, קבצי תלוש שכר (לזמן עיבוד בלבד), טיקרים של מניות לניתוח, ופרמטרים שמוזרמים לבקשות תובנות/Banner Tip (שם, XP, סטריק, יעדים פיננסיים). • קלט בכלים פיננסיים: ערכים שתזין/י במחשבונים השונים (משכורת, הוצאות, גיל פרישה, יעדי חיסכון וכו') — נשמרים מקומית במכשיר בלבד. • סטטיסטיקות מצרפיות אנונימיות: של תלושי שכר (טווחים בלבד, ללא סכומים מדויקים), לטובת השיתוף עם הקלאן. נשמרות מקומית במכשיר. • שיוך לוריאנט בניסוי (A/B): מזהה וריאנט אנונימי לטובת מדידת אפקטיביות של מסכים/טקסטים.

2. מטרות השימוש במידע

• תפעול שוטף: אספקת שירותי האפליקציה, ניהול חשבון, חישוב ניקוד והפעלת טבלאות מובילים (Leaderboards). • פרסונליזציה: שימוש בטכנולוגיות ואלגוריתמים (לרבות AI) לצורך התאמה אישית של מסלולי הלמידה, רמת הקושי והצעת תכנים והטבות פיננסיות הרלוונטיים לפרופיל שלך. • אבטחה ושיפור: ניתוח סטטיסטי אנונימי לפיתוח השירות, אבטחת מידע, ומניעת הונאות.

3. שיתוף מידע עם צדדים שלישיים

החברה לעולם לא תמכור את המידע האישי המזהה שלך. שיתוף מידע יתבצע במקרים הבאים: • העברת לידים למימוש הטבות: בעת לחיצה על "מימוש הטבה" דרך חנות ההטבות, הנך נותן/ת הסכמה מפורשת להעברת פרטי הקשר שלך לאותו גוף ספציפי. • ספקי שירות AI: - שירותי AI חיצוניים — לעיבוד אוטומטי של צ'אט, תלוש שכר, תובנות אישיות, Banner Tip וניתוח מניות (מהיר ועומק). העיבוד מתבצע בשרתי הספקים, בארה"ב או באירופה. • ספקי שירות טכנולוגיים: שירותי ענן, אחסון וניתוח נתונים הפועלים מטעמנו ותחת הסכמי סודיות קפדניים: - RevenueCat — ניהול מנויים והרשמות. - Supabase — ניהול חשבונות משתמש ובסיס נתונים. - Vercel — אירוח ה-API והשרת. - Cloudflare R2 / Vercel Blob — אחסון תמונות וקבצים. - PostHog — אנליטיקה, A/B testing ו-session replay (עם מיסוך אוטומטי של שדות קלט). - Firebase (Google) — Analytics ו-Crashlytics לאיתור באגים. - Facebook SDK (Meta) — מזהי פרסום ואירועי המרה (כפוף לאישור App Tracking Transparency). - Google AdMob — מודעות (כפוף לאישור App Tracking Transparency). - Google / Apple Sign-In — אימות התחברות. • רשויות החוק: מסירת מידע ככל שנידרש לכך על פי חוק או צו שיפוטי. העברת מידע אל מחוץ לישראל/EU: חלק מהספקים (כולל ספקי שירותי AI, Vercel, PostHog) מעבדים מידע בשרתים בארה"ב או באירופה. העברה זו מבוצעת בהתאם לדרישות חוק הגנת הפרטיות הישראלי ובאמצעות הסכמי עיבוד מידע (DPA) סטנדרטיים.

4. דיוור ישיר והודעות שיווקיות

בעצם הרשמתך, הנך מסכים/ה לקבלת הודעות מערכת, תזכורות למידה, התראות פוש, מסרונים ודברי פרסומת מ-FinPlay ומשותפיה, בהתאם לסעיף 30א לחוק התקשורת (בזק ושידורים), התשמ"ב-1982. הודעות פרסומיות יסומנו במילה "פרסומת" בכותרת ההודעה. ניתן להסיר עצמכם מרשימת התפוצה בכל עת באחת מהדרכים הבאות: • דרך הגדרות האפליקציה • דרך הגדרות המכשיר (להתראות פוש) • דרך לינק "הסרה מרשימת תפוצה" שמופיע בכל מייל שיווקי • בתגובה לכל מייל עם המילה "הסר" • בפנייה לכתובת support@finplay.me ההסרה תיכנס לתוקף תוך 3 ימי עסקים.

5. זכויותיך (עיון, תיקון, מחיקה ונייטרליות)

על פי חוק הגנת הפרטיות, הינך זכאי/ת: • לעיין במידע האישי שאנו מחזיקים עליך. • לתקן מידע שגוי או לא מעודכן. • למחוק את חשבונך באופן מלא, לרבות כל הנתונים האישיים — דרך עמוד מחיקת החשבון: delete-account או דרך support@finplay.me. • לקבל עותק של הנתונים שלך (Data Portability) — לפי בקשה דרך support@finplay.me, נשלח אליך תוך 30 ימי עסקים קובץ JSON עם הנתונים האישיים שלך. • לבקש Opt-Out מעיבוד AI — לפי בקשה דרך support@finplay.me. שים לב שאופציה זו תשבית את היכולת להשתמש בכלי הצ'אט, ניתוח תלוש שכר, וניתוח מניות. מימוש זכויות אלה הוא בחינם ויטופל תוך 14 ימי עסקים.

6. אבטחת מידע

אנו נוקטים באמצעי אבטחה טכנולוגיים וארגוניים מחמירים כדי להגן על המידע שלך (לרבות הצפנה). עם זאת, מובהר כי אין מערכת המאובטחת באופן הרמטי לחלוטין מפני חדירות סייבר.

7. ילדים

השימוש באפליקציה מותר מגיל 16 ומעלה. איננו אוספים מידע ביודעין מילדים מתחת לגיל 16. אם נודע לנו שילד מתחת לגיל זה מסר מידע, נמחק אותו מיידית.

8. שינויים במדיניות

אנו עשויים לעדכן את מדיניות הפרטיות מעת לעת. שינויים מהותיים יפורסמו באפליקציה ויעודכנו בתאריך "עדכון אחרון" בראש מסך זה. בעת עדכון מהותי: יוצג למשתמש מודאל ייעודי בכניסה הבאה לאפליקציה, עם סיכום קצר של מה השתנה, ויידרש לאשר במפורש את התנאים המעודכנים. ללא אישור — לא ניתן יהיה להמשיך להשתמש באפליקציה. במקביל, נשלח מייל לכל המשתמשים הרשומים עם סיכום וקישור לתנאים המלאים. המשך השימוש באפליקציה לאחר אישור מהווה הסכמה למדיניות המעודכנת.

Terms of Use

Welcome to FinPlay ("the App"). Use of the App is subject to your full agreement to the following terms.

1. Nature of Service & No Financial Advice

FinPlay is an educational technology platform for learning financial literacy through gamification and simulations. All content, data, indices, and simulators are for practice and enrichment purposes only. The company does not hold a license under the Investment Advice Regulation Law, 5755-1995. No information in the App constitutes financial, pension, tax, or investment advice. Any financial decision you make in the real world is your sole responsibility.

2. Investment Simulator & Market Data

The "sandbox" simulator operates in a virtual environment with no financial risk. Market data may be delayed, historical, or illustrative. Success in the simulator does not guarantee or indicate success in real-world investing or trading.

3. Game Economy & No Gambling

Progress is based solely on skill, knowledge, learning, and persistence (Skill-Based), with no element of chance or luck. Virtual coins have no monetary or commercial value outside the App and cannot be converted to cash. We reserve the exclusive right to change benefit prices, limit redemptions, or cancel the rewards program at any time without prior notice.

4. Age Restriction

Use is permitted from age 16 for educational purposes (subject to parental/guardian consent for minors). Exposure to financial commercial offers and benefit redemption is restricted to users 18 and above.

5. Third Parties & Affiliates

The App displays links, offers, and benefits from financial and commercial entities. FinPlay may receive referral commissions (CPA/Affiliate) for actions you perform with these partners. FinPlay is not a party to your engagement with them and bears no responsibility for their services.

6. Limitation of Liability

The service is provided AS IS. FinPlay, its directors and employees shall not be liable for any direct or indirect damage, financial loss, lost profits, technical failures, or distress arising from use of the App. Exclusive jurisdiction: Tel Aviv-Jaffa courts.

7. AI Tools & Automated Processing

The App includes several tools that rely on AI services for data processing. When using the chat with Captain Shark, payslip analysis, stock analysis (quick/deep), personal insights, or Banner Tip, the content you provide is transmitted over an encrypted connection (TLS 1.2+) for processing by AI services, and a result is returned. AI results are intended for learning and enrichment only, do not constitute financial, pension, tax, or legal advice, and may contain errors, inaccuracies, or hallucinations. FinPlay is not responsible for these outputs or any reliance on them.

8. Payslip Analyzer

The payslip analyzer lets you upload a photo or PDF of a payslip for automated analysis. The flow: • The file is sent over an encrypted connection (TLS 1.2+) to FinPlay's server for the duration of processing only. • The file is then transmitted to an AI service for analysis (typically under 60 seconds). • The original file is not persisted on FinPlay's server, in logs, or at Google beyond the processing window. • The full analysis result is stored only in device RAM and is cleared when the screen closes. • Anonymized aggregate statistics (gross salary range in ₪1,000 buckets, rounded pension percentage, presence of education fund — without exact amounts, name, or full breakdown) are stored locally on your device in MMKV to enable the clan-sharing feature. • You can delete the local statistics at any time via Settings > Clear Data. A dedicated consent screen is shown before first use of this tool. Continued use constitutes explicit consent to this processing flow.

9. Interactive Financial Tools

The App offers nine financial calculators (mortgage, pension, payslip breakdown, income tax, savings goals, compound interest, budget check, vacation calculator, and more). Input you provide to these tools is stored locally on your device only (MMKV) for continued use of the tool, and is not transmitted to FinPlay servers or any third party. Results are general estimates only and do not constitute tax, pension, investment, or legal advice. Consult a licensed professional before making real-world financial decisions.

10. A/B Testing & Personalization

To improve user experience, FinPlay runs automated experiments on different variants of screens, copy, and offers (Multi-Armed Bandit). Variant assignment is anonymous, not tied to personal identity, and stored in PostHog for analytics and improvement purposes only.

Privacy Policy

FinPlay is committed to protecting your privacy and operates in accordance with the Israeli Privacy Protection Law, 5741-1981.

1. Information We Collect

• Account & contact details: full name, email, phone number, date of birth, avatar. • Learning & behavioral data: module progress, quiz results, simulator choices and actions, usage duration, activity streaks. • Technical & digital info: device type, OS version, IP address, advertising/device identifiers, analytics data. • Content sent for AI processing: questions you send to the Captain Shark chat, payslip files (for processing duration only), stock tickers for analysis, and parameters streamed into insights/Banner Tip requests (name, XP, streak, financial goals). • Input to financial tools: values you enter into the various calculators (salary, expenses, retirement age, savings goals, etc.) — stored locally on device only. • Anonymized aggregate statistics: of payslips (ranges only, no exact amounts) for the clan-sharing feature. Stored locally on device. • A/B test variant assignment: anonymous variant identifier for measuring screen/copy effectiveness.

2. Purpose of Use

• Operations: providing App services, account management, scoring, leaderboards. • Personalization: using technologies and algorithms (including AI) for personalized learning paths, difficulty levels, and relevant financial content and benefits. • Security: anonymous statistical analysis for service improvement, data security, and fraud prevention.

3. Information Sharing

We will never sell your personally identifiable information. Sharing occurs in the following cases: • Benefit redemption: when you actively click "Redeem Benefit" through the rewards store, you give explicit consent to share your contact details with that specific entity. • AI service providers: - External AI services — for automated processing of chat, payslip, personal insights, Banner Tip, and stock analysis (quick and deep). Processing occurs on the providers' servers, in the US or Europe. • Technology providers: cloud, storage, and analytics services operating on our behalf under strict confidentiality agreements: - RevenueCat — subscription and purchase management. - Supabase — user accounts and database. - Vercel — API and server hosting. - Cloudflare R2 / Vercel Blob — image and file storage. - PostHog — analytics, A/B testing, and session replay (with automatic input field masking). - Firebase (Google) — Analytics and Crashlytics for debugging. - Facebook SDK (Meta) — advertising identifiers and conversion events (subject to App Tracking Transparency consent). - Google AdMob — ads (subject to App Tracking Transparency consent). - Google / Apple Sign-In — authentication. • Law enforcement: as required by law or court order. International data transfer: Some providers (including AI service providers, Vercel, PostHog) process data on servers in the US or Europe. This transfer is performed in compliance with the Israeli Privacy Protection Law and via standard Data Processing Agreements (DPAs).

4. Direct Marketing & Communications

By registering, you agree to receive system messages, learning reminders, push notifications, SMS, and promotional messages from FinPlay and its partners, per Section 30A of the Communications Law (Bezeq and Broadcasts), 5742-1982. Promotional messages will be marked with the word "פרסומת" (advertisement) in the subject line. You may unsubscribe at any time via any of the following: • App settings • Device settings (for push notifications) • The "Unsubscribe" link in any marketing email • Replying to any email with the word "unsubscribe" • Contacting support@finplay.me Unsubscription will take effect within 3 business days.

5. Your Rights

Under the Privacy Protection Law, you are entitled to: • Access the personal information we hold about you. • Correct inaccurate or outdated information. • Delete your account fully, including all personal data — via the account deletion page: delete-account or via support@finplay.me. • Receive a copy of your data (Data Portability) — upon request via support@finplay.me, we will send you a JSON file with your personal data within 30 business days. • Request opt-out from AI processing — upon request via support@finplay.me. Note that this will disable use of the chat tool, payslip analyzer, and stock analysis. Exercising these rights is free of charge and will be processed within 14 business days.

6. Data Security

We employ strict technological and organizational security measures to protect your data (including encryption). However, no system is completely immune to cyber intrusions.

7. Children

Use is permitted from age 16. We do not knowingly collect information from children under 16. If we learn that a child under 16 has provided information, we will delete it immediately.

8. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be announced in the app and the "Last updated" date at the top of this screen will reflect the change. Upon a material update: a dedicated modal will be presented to the user on the next app entry, with a short summary of what changed, requiring explicit re-acceptance of the updated terms. Without acceptance — continued use of the app will not be possible. In parallel, an email will be sent to all registered users with a summary and a link to the full updated terms. Continued use of the app after acceptance constitutes consent to the updated policy.
